A person who is not a party to these terms and conditions or a Contract shall not have any rights under or in connection with them.

The laws of the State of Rajasthan govern these Terms and Conditions and your use of this Site, and you irrevocably consent to the exclusive jurisdiction of the courts in Jaipur, Rajasthan for any action arising out of or relating to these Terms and Conditions or use of this Site.

By using this Site, you hereby waive any objection to this venue as inconvenient or inappropriate and agree to exclusive jurisdiction and venue in Jaipur, Rajasthan.

In lieu of a lawsuit, you agree that any dispute relating to the Site shall be submitted to confidential arbitration. The arbitration shall be conducted by the sole arbitrator, appointed by the mutual consent of the parties. The arbitration shall be conducted according to the Arbitration and Conciliation Act, 1996 and the arbitral proceedings shall be conducted in Jaipur, Rajasthan. Further, only the courts situated in the judicature of Jaipur, Rajasthan shall have the jurisdiction to rule in relation to such arbitral proceedings. The arbitrator’s ruling shall be binding and any potential award of damages may be entered as a judgment in any court of competent jurisdiction, to the fullest extent permitted by applicable law.

Arbitrations shall proceed on an individual basis. By submitting your claim to arbitration, as is required by the Terms, you waive the right to trial by Court, to assert or participate in a class-action lawsuit or class-action arbitration, and to assert or participate in any joint or consolidated lawsuit or joint or consolidated arbitrations of any kind.

If any provision of The Agreement is found for any reason to be unlawful, void, or unenforceable, the remaining provisions of the agreement will continue to be fully valid, binding, and enforceable.

Sunita Shekhawat Jaipur shall have the right in its absolute discretion at any time and without notice to amend, remove, or vary the Terms and Conditions set for there, or to make changes on any page of the Site. In the event that changes are made, you may be required to reaffirm The Agreement, whether by use of the Site or otherwise.

You agree and understand that no partnership, agency, employment, or joint venture may be established as a result of this Agreement or your use of this Site.

We may assign our rights under the Agreement, in whole or in part, to any person or entity at any time, without notice or your consent. You may not assign your role according to the Agreement to any other party without our express, written consent.

If you breach the Agreement and we do not take action, we are not waiving the right to do so, and we will still be entitled to use our rights and remedies in any other instance of breach of the Agreement.

You hereby agree that your violation of the Agreement would cause irreparable harm and damage if the Agreement was not specifically enforced, and therefore you agree that we shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies with respect to breaches of the Agreement, as well as other remedies that we have available to us under the prevailing law.

The above Terms and Conditions constitute the entire agreement of the parties and hereby supersedes all preceding and contemporaneous agreements between you and Sunita Shekhawat Jaipur. Any waiver of any provision of the Agreement will be effective only if in writing and signed by a Director of Sunita Shekhawat Jaipur.

Sunita Shekhawat Jaipur offers “E-Gift Cards” (also called E-Gift Codes) and “Promotional Codes” (also called “Promo Codes” or “E-Reward Codes”). Please see below for the terms and conditions that apply to each one.

An E-Gift Card is not a credit card or debit card.

All provisions of these Terms & Conditions are enforced except where prohibited by law.

An “E-Gift Card” or “E-Gift Code” is a virtual, electronic gift card sent to the customer and/or recipient via email in the form of a code. The E-Gift Card is available for purchase online from Sunita Shekhawat Jaipur (the “Website”) in dollar denominations ranging from INR 500 to INR 2,00,000. The term “E-Gift Card” does not include “Promotional Code” (also called “Promo Code” or “E-Reward Code”).

The following forms of payment are accepted for the purchase of E-Gift Cards: Visa, MasterCard, American Express, and Discover. An E-Gift Card can be redeemed only through www.sunitashekhawat.com (the “Website”) and may only be used toward the purchase of merchandise or services offered for sale in the country for which the E-Gift Card is issued. To redeem an E-Gift Card, you must enter your E-Gift Card Code in the E-Gift Cards area on the shopping cart page.

If you use your E-Gift Card to make a purchase on the website and your purchase does not exhaust the credit balance on your E-Gift Card, then you may use the remaining balance for future purchases, subject to the restrictions set forth herein. If you use your E-Gift Card to make a purchase on the website which exceeds the credit balance on your E-Gift Card, you will have to use another payment method to pay for the remainder of your purchase.

Returned items originally purchased with the use of an E-Gift Card, and returned within 14 days of receiving the order, will be refunded to the E-Gift Card that was used for the purchase.

Sunita Shekhawat Jaipur E-Gift Cards are not refundable.

E-Gift Cards do not expire.

No Dormancy Fee: Sunita Shekhawat Jaipur will not assess a service fee or dormancy fee with respect to an E-Gift Card.

An E-Gift Card cannot be used to purchase a new E-Gift Card.

Additional credit cannot be added to an E-Gift Card after it has been issued by Sunita Shekhawat Jaipur.

Lost or stolen E-Gift Cards are replaced (to the extent of the remaining balance) only with valid proof of purchase.

A “Promotional Code” (also called “Promo Code” or “E-Reward Code”) means any promotional code given y by Sunita Shekhawat Jaipur as part of awards, loyalty, or promotional program without any money or other thing of value being paid in exchange for Promotional Code. The term “Promotional Code” does not include “E-Gift Cards” or “E-Gift Card Codes”.

A PROMOTIONAL CODE OFFERED WHEN YOU PURCHASE A PRODUCT WILL BE ISSUED TO YOU 14 DAYS AFTER YOU ARE INVOICED FOR YOUR PURCHASE UNLESS OTHERWISE SPECIFIED.

A Promotional Code can be redeemed only through www.sunitashekhawatjaipur.com (the “Website”) and may only be used toward the purchase of in-stock merchandise offered for sale in the country for which the Promotional Code is issued. To redeem a Promotional Code, you must enter your Promotional Code in the “Promo Code” area on the shopping cart page.

If you use your Promotional Code to make a purchase on the website and your purchase does not exhaust the credit balance on your Promotional Code, then you may use the remaining balance for future purchases, subject to the restrictions set forth herein. If you use your Promotional Code to make a purchase on the website which exceeds the credit balance on your Promotional Code, you will have to use another payment method to pay for the remainder of your purchase.

Items purchased with a Promotional Code and returned within 14 days of receipt of the purchase, will result in the reactivation of the code, which will be valid for 7 days following the date of the return.

Promotional Codes are not redeemable for cash.

Sunita Shekhawat Jaipur is under no obligation to restore lost or stolen Promotional Codes.

A Promotional Code cannot be used to purchase a Sunita Shekhawat Jaipur E-Gift Card code.

Additional credit cannot be added to a Promotional Code after it has been issued by Sunita Shekhawat Jaipur.

A PROMOTIONAL CODE EXPIRES THREE (3) MONTHS AFTER IT IS ISSUED UNLESS OTHERWISE SPECIFIED.

If you receive a Promotional Code in connection with your purchase of an item, your Promotional Code will be voided if you subsequently return that item to Sunita Shekhawat Jaipur for a refund.

Please note: Sunita Shekhawat Jaipur reserves the right to block the customer account of any customer who repeatedly seeks to return an item (for which a Promotional Code was issued when the item was purchased), for a refund after first using that Promotional Code toward the purchase of a different item.

A Promotional Code may not be resold, and Sunita Shekhawat Jaipur reserves the right to void any Promotional Code it believes has been resold.
